Terms and Conditions

Welcome to Smartboard PH. Please carefully read the following terms and conditions, as they govern your purchase and use of Smartboard PH products. By purchasing or using our products, you agree to these terms.
1. Product Description
The product sold under Smartboard PH is an interactive and smart digital whiteboard (“the Product”). We aim to ensure all product descriptions and specifications are accurate; however, product images may vary slightly from the actual product due to lighting or screen differences.
2. Warranty
1-Year Warranty: Smartboard PH provides a one-year limited warranty for all digital whiteboards, covering defects in materials and workmanship. The warranty period begins on the date of purchase.
Warranty Exclusions: This warranty does not cover and is not limited to:
- Any modification or physical damage to the product will void the warranty.
- The Product serial number or warranty seal has been removed, erased, defaced, altered, tampered or is illegible;
- Damages due to misuse, abuse, or neglect
- Unauthorized repairs or modifications
- Natural wear and tear: Deterioration of the Product due to normal wear and tear, including without limitation rust or stains;
- Missing accessories or external parts of the Product after signing the delivery receipt
- General maintenance, password reset assistance, routine servicing and cleaning, updating/upgrading of software, installation of software or applications, product demonstration, or any other service other than repair;
- The Product shows evidence of impact, shock; accident; fire, flood, earthquake, lightning, or other acts of nature; sand, liquid, or food damage; exposure to extreme thermal or environmental conditions beyond product specifications or a rapid change in such conditions; electrostatic discharge; chemical corrosion; abuse, mishandling, improper installation, operation or maintenance, use of wrong electrical supply or voltage;
- damage during shipment to/from Smartboard PH authorized service center; damage caused by the installation of any software, programs or applications, or use of any accessories, consumable items or peripheral equipment not provided or approved by Smartboard PH for use with the Product; improper alteration, modification, adjustment, tampering; replacement of parts with parts not provided or approved by Smartboard PH; or dismantling, opening, service or repair performed other than by Smartboard PH authorized service center; or any other use contrary to the product manual.
- Any other circumstance such that repair would be contradictory or not in compliance with good business practice.
Any unit found to be defective upon first use must be reported within 7 calendar days from delivery. Failure to report within this period constitutes acceptance of the unit as delivered.
To claim the warranty, please contact our customer service team at sales@smartboard.ph with your proof of purchase and a description of the issue.
3. Shipping and Delivery
- Shipping Timeframe: All orders will be processed and shipped within 15-30 business days upon receipt of payment. This timeframe may vary depending on availability and other factors.
- Available Products: Delivery lead time: 1-7 days within Metro Manila upon down payment receipt if the unit is available in our warehouse.
- No Stocks: For lead time to non-availability of specified unit, 30-45 days is required for the delivery. Please allow a 7-10 days extension period for bulk and staggered orders on committed estimated time of arrival for uncontrollable circumstances (e.g. port congestion, transit delays, weather disturbances).
- Shipping Costs: Shipping fees will be calculated at checkout and may vary depending on the location. Customers are responsible for these costs unless specified otherwise.
- Customs and Import Fees: For international orders, buyers are responsible for any applicable import duties or taxes imposed by the destination country.
- Delivery and Clearance: For all items to be delivered by a third-party courier or picked up directly by the client, Smartboard PH requires a clearance check before release. Clients opting to forgo the inspection must sign a waiver acknowledging full responsibility for any damages or issues upon receipt. Smartboard PH will not be held liable once the item has left the warehouse premises without clearance.

- Any payment made to other accounts will not be honored by the company.
- By signing the Delivery Receipt, the Client confirms that all delivered units have been received in good condition, tested, and found compliant with agreed specifications. Any claims for damage or defect after acceptance shall be subject exclusively to the Warranty provisions, and not replacement or refund.
- Smartboard PH shall not be liable for delays or failure to perform caused by events beyond reasonable control, including but not limited to natural disasters, port congestion, strikes, pandemics, government regulations, or supply chain disruptions.
4. Refunds and Revisions
- No refunds allowed: You may modify your order for the same value or a greater amount, but refunds are not permitted.
- All initial payment/s that was provided whether partial or full, to secure a specific quotation or a unit, are non-refundable and non-negotiable. Please note that we also outsource the components of our products from different suppliers in which we cannot get any refund for cancelled orders.
- Minor revisions on approved quotations or sales order (items that does not affect the specifications of the ordered unit) are generally acceptable but will be needing the approval of the management of the company. Therefore, a formal letter shall be provided to the company stating a detailed narrative together with your specific request/s towards your concern/s.
5. Limitation of Liability
Smartboard PH is not responsible for any incidental or consequential damages arising from the use or inability to use the product. This includes, but is not limited to, loss of data, loss of revenue, or any other commercial damages. Commercial use includes, but is not limited to, use in schools, universities, offices, training centers, churches, events, rentals, or shared facilities.
Smartboard PH does not warrant uninterrupted or error-free operation of operating systems, firmware, or third-party applications. Compatibility with future software updates, applications, or operating systems is not guaranteed. Issues arising from third-party software, apps, licenses, or updates are not covered by warranty.
Smartboard PH shall not be liable for loss of data, content, configurations, or software stored on the Product. Clients are responsible for backing up all data prior to servicing, repair, or replacement.
Smartboard PH’s maximum liability will not exceed the purchase price of the product.
6. Usage & Limitation
- Proper Handling: Customers are advised to handle the product with care and follow all operating instructions provided. Avoid exposure to extreme temperatures, moisture, and direct impact to prevent damage.
- Installation and Usage: The product should be installed and used as per the instructions provided by Smartboard PH. Any issues resulting from improper setup or handling are not covered under warranty.
- The Smartboard PH is not designed for life-critical, medical, or health-critical applications.
7. Modifications to Terms and Conditions
Smartboard PH reserves the right to modify or update these terms and conditions at any time without prior notice. Any changes will be effective immediately upon posting on our website. Continued use of our services or products signifies acceptance of the updated terms.
8. Intellectual Property Rights
All content, designs, and trademarks related to Smartboard PH are the intellectual property of Smartboard PH. Unauthorized use or reproduction of any content from our website or marketing materials is strictly prohibited.
9. Governing Law
These terms and conditions shall be governed by and interpreted in accordance with the laws of the Philippines. Any disputes arising out of these terms will be subject to the exclusive jurisdiction of the courts of Marikina City, Metro Manila.
10. Security
Smartboard PH guarantees that units released by the company do not contain any pre-installed tracking, monitoring, or surveillance software. Smartboard PH shall not be liable for security breaches, spyware, or malware introduced through third-party applications, external devices, or network connections installed or used by the Client.
11. Severability Clause
If any provision of these Terms is held invalid, the remaining provisions shall remain in full force and effect.
